No More "Limbo" for "Limbaugh" - Rush Pulls Music From Limbaugh Show

According to the Huffington Post, Rush has formally demanded that Rush Limbaugh cease and desist using the band's music as bumper music on his show.  Here is the full text of their lawyer's letter to the show:
The Rush Limbaugh Show 1270 Avenue of the Americas New York, NY 10020 Premiere Radio Networks.

Ladies & Gentlemen:
I am the attorney for Rush, their management company, S.R.O. Management Inc., their music publishing company, Core Music Publishing and their record company, The Anthem Entertainment Group Inc.
According to media reports, Rush Limbaugh, Premiere Radio Networks and The Rush Limbaugh Show have been using Rush's recorded music as part of what is essentially a political broadcast.
The use of Rush's music in this way is an infringement of Rush's copyrights and trademarks. The public performance of Rush's music is not licensed for political purposes and any such use is in breach of public performance licenses and constitutes copyright infringement. There are civil and criminal remedies for copyright infringement, including statutory damages and fines.
(see sections 501-513 of Title 17 of the United States Code
In addition, the use of Rush's music in this manner implies an endorsement of the views expressed and products advertised on the show, and is in breach of not only copyright and trademark rights, but also, of section 51 of the New York Civil Rights Law (excerpt attached).
Accordingly, we hereby demand that you immediately stop all use of Rush's music and confirm that you will do so.
Yours very truly,
Robert A. Farmer
Director of Legal Affairs

  1. News alert! Limbaugh talks using liberal speech, gets in major trouble as conservatives are to never stoop this low. Greater things are expected of the conservative side. To Rush the bands management great way to show your hypocrisy!

  3. Lame, first they don’t allow Rand Paul to use their music now Limbaugh. I thought the band was inspired by Ayn Rand not Stalin. I used to love the band growing up now I’m losing my respect more and more. I'm not even buy the new album since they are getting involved with US politics. I have actually never even listened to Limbaugh but now I will thanks to these hypocrite left wingers.

  4. Most awesome. To another poster, protecting and having control over one's own creation is at the very center of Ayn Rand's philosophy.

  5. What an idiot, they don't want to be involved in US politics, that's why they want limbaugh to stop using their music, that and the fact that limbaugh is an asshole. Used to be a fan? Why are you commenting on a RUSH fan site now? Go listen to limbaugh, nazi.

  6. Im the biggest 15 year old rush fan on earth, biggest influences in my life, but im also a hardcore repbulican, this shouldent concen any true rush fan after all you look up to them for their music and how awsome they are, not their polotical views right???

  7. 15 year old Republican? Really? Remember that when they vow to cut college funding for students in a few years, if they're in power :-)

Also, isn't it amazing that the right-wing *loves* to want people to boycott places (can we say the JCPenney-Ellen DeGeneres dustup a few weeks ago), but when it comes back on them, it's called "fascism"...really? And you call the left-wing hypocrites? Take a look in the mirror before saying that ^_^

Besides, have you ever heard Neil take a right-wing stance in his life? He described himself (in his words on his site) as a "bleeding-heart libertarian," so anyone on the right who thinks that he had their back...try again, you fail :-)

  8. I'm a now tainted fan of both. This is lame. Radio shows pay for the use of bumper music. Now one won't hear 10 seconds of Spirit of Radio on Limbaugh's show, and the band won't get some cash. And of course if the music can't be "licensed for political purposes" then the same demand must be made of liberal radio shows. Somehow I suspect that demand won't be made. Sigh.

  9. Cut college funding? Forget about that. Lets cut Obama's stupid energy plan and open up ANWR drilling in Alaska and that won't be necessary.

  10. To Power Windows:

Drinking the cool aide; "drill baby drill"?... we are. We have drilling sites than ever before - production is up, imports are down, but exports are also up. There is no such thing as an American barrel of oil. Oil companies ship oil out of this country to the highest bidder. Ever notice that every time we have an election the price of gas goes up in an attempt to effect the election.

Limbaugh has now lost 45 sponsors. Yee-ah!

And just because you buy a song on I-tunes doesn't mean you get to use it to promote a radio show.

  11. Limbaugh may have lost 45 out of 18,000 sponsors and he doesn’t sound too concerned, so good luck getting rid of him. You liberal dorks have been trying now for how many decades to get rid of him? We’ll get rid of loser Obama before you get rid of Limbaugh, Suckers.

  12. Not surprisingly, this has turned into a political debate. Lets keep it topic related people.

As the wise man once said, never talk politics or religion with your friends and family. When you do, this thread is what happens!

  13. I wonder if this came from Rush or just their management/music co? elRushbo has been playing this song for years on his radio show.

  14. Rush Limbaugh is nothing more than a egotistical turd that floats lower in the bowl than most. He should have known better than to capitalize on the use of copyrighted material in the first place. Cheers to Robert Farmer for his persuasive note. Long live Rush and the freedom of music.

  15. Barack Hussein Obama is nothing more than a turd washed out from the sewers of Chicago. The Democrats will lose the White House and Limbaugh will still be pissing off all you haters long after Obama has left the White House . Long Live Limbaugh, stupid move on the part of Rush (the band) they just lost a fan.

  16. Unknown: Open your mind man!........

  17. Rush are only doing this now to impress the so called hipsters at Rolling Stone and the Rock and Roll Hall of Fame crowd.Do they not remember that prior to 1980, that most radio stations would not play any of their music? If any leftist radio jock or politician played their stuff, my guess is that they would just let it go.

  18. It's sad that I now have a very hypocritical view of the band after being a fan since 1989. I mean they don't want their music to be played on political shows, yet they choose a political TV show to make their US TV debut.

I know some will say that Colbert is a comedy show and not a political show. However it is since it makes ridicule of the political process, and I'm sure that some of its viewers take everything he says as the truth, it is one.

It's way to easy for comedians (even the bad ones such as Colbert) to hide behind the "I'm just a Comedian" card.

I just hope that the band and its management are willing to make sure that the removal of their music from all political shows will include liberal shows and not just shows that are conservative.
