Ladies & Gentlemen:
I am the attorney for Rush, their management company, S.R.O. Management Inc., their music publishing company, Core Music Publishing and their record company, The Anthem Entertainment Group Inc.
According to media reports, Rush Limbaugh, Premiere Radio Networks and The Rush Limbaugh Show have been using Rush's recorded music as part of what is essentially a political broadcast.
The use of Rush's music in this way is an infringement of Rush's copyrights and trademarks. The public performance of Rush's music is not licensed for political purposes and any such use is in breach of public performance licenses and constitutes copyright infringement. There are civil and criminal remedies for copyright infringement, including statutory damages and fines.

In addition, the use of Rush's music in this manner implies an endorsement of the views expressed and products advertised on the show, and is in breach of not only copyright and trademark rights, but also, of section 51 of the New York Civil Rights Law (excerpt attached).
Accordingly, we hereby demand that you immediately stop all use of Rush's music and confirm that you will do so.

ReplyDeleteLame, first they don’t allow Rand Paul to use their music now Limbaugh. I thought the band was inspired by Ayn Rand not Stalin. I used to love the band growing up now I’m losing my respect more and more. I'm not even buy the new album since they are getting involved with US politics. I have actually never even listened to Limbaugh but now I will thanks to these hypocrite left wingers.

And you call the left-wing hypocrites? Take a look in the mirror before saying that ^_^
Besides, have you ever heard Neil take a right-wing stance in his life? He described himself (in his words on his site) as a "bleeding-heart libertarian," so anyone on the right who thinks that he had their back...try again, you fail :-)
I'm a now tainted fan of both. This is lame. Radio shows pay for the use of bumper music. Now one won't hear 10 seconds of Spirit of Radio on Limbaugh's show, and the band won't get some cash. And of course if the music can't be "licensed for political purposes" then the same demand must be made of liberal radio shows. Somehow I suspect that demand won't be made. Sigh.

And just because you buy a song on I-tunes doesn't mean you get to use it to promote a radio show.

ReplyDeleteRush are only doing this now to impress the so called hipsters at Rolling Stone and the Rock and Roll Hall of Fame crowd.Do they not remember that prior to 1980, that most radio stations would not play any of their music?If any leftist radio jock or politician played their stuff, my guess is that they would just let it go.
ReplyDeleteIt's sad that I now have a very hypocritical view of the band after being a fan since 1989. I mean they don't want their music to be played on political shows, yet they choose a political TV show to make their US TV debut.
ReplyDeleteI know some will say that Colbert is a comedy show and not a political show. However it is since it makes ridicule of the political process, and I'm sure that some of its viewers take everything he says as the truth, it is one.
It's way to easy for comedians (even the bad ones such as Colbert) to hide behind the "I'm just a Comedian" card.
I just hope that the band and its management are willing to make sure that the removal of their music from all political shows will include liberal shows and not just shows that are conservative.
